This is an English translation of the German terms and conditions (Allgemeine Geschäftsbedingungen). In case of discrepancies, the German version prevails.

Scope

These Terms & Conditions apply to the use of the Mentavo mobile application, the associated website mentavo.app, and all related digital services.

These Terms apply to all users who use Mentavo, create a user account, or use paid features.

Description of services

Mentavo is a digital application for personal development, self-reflection, and organizing everyday life.

The app may include in particular the following features:

• journaling
• daily check-ins
• goals and habits
• routines
• personal notes
• AI-powered coaching and reflection features
• astrology features
• progress displays
• reminders and push notifications
• paid premium features

The specific scope of features may vary depending on the version, platform, user account, and chosen subscription.

Mentavo does not guarantee any specific personal, psychological, health-related, professional, or financial outcome. The app is intended to support, structure, and facilitate self-reflection.

Registration and user account

Creating a user account is required to use essential features.

Users undertake to provide accurate and complete information when registering and to keep their access credentials confidential.

The user account is personal and may not be transferred to third parties without Mentavo's consent.

Users are responsible for keeping their password secure and protecting access to their account from unauthorized use.

Minimum age

Mentavo is intended for users aged 14 and older.

Persons under the age of 14 may not use Mentavo.

Where the law of the user's place of residence requires parental consent, Mentavo may only be used with such consent.

Paid subscriptions may only be entered into by persons legally entitled to do so, or with the required consent of a parent or legal guardian.

Free and paid features

Mentavo may offer both free and paid features.

The scope of free features may be limited.

Paid features may be offered in particular through in-app purchases or subscriptions within the Apple App Store or Google Play Store.

Prices, terms, trial periods, and scope of services are displayed within the app or the respective app store before a paid offer is concluded.

Subscriptions, term, and cancellation

Paid subscriptions renew automatically unless cancelled in good time through the respective app store.

Subscriptions are generally managed and cancelled through the Apple App Store or Google Play Store, depending on which platform the subscription was purchased through.

After cancellation, access to paid premium features generally remains available until the end of the billing period already paid for.

Mentavo does not have full access to the app stores' payment management and may in some cases be unable to process cancellations, refunds, or payment changes directly. The terms of the respective app store apply in addition.

Withdrawal and refunds

Consumers may have statutory rights of withdrawal.

For purchases made through the Apple App Store or Google Play Store, the respective terms and procedures of the app store take precedence for withdrawal, refunds, and payment processing.

Where Mentavo itself concludes contracts via the mentavo.app website, users will be separately informed of any existing right of withdrawal before the contract is concluded.

Where legally required, Mentavo provides an electronic means of withdrawal on the website.

AI-powered features

Mentavo may offer AI-powered features, for example for reflection, goal planning, motivation, analysis of personal input, or generating suggested responses.

AI-generated content is produced automatically and may be inaccurate, incomplete, misleading, or incorrect.

The AI features are intended solely for personal support, inspiration, and self-reflection.

Mentavo is not a substitute for medical, psychological, psychotherapeutic, legal, tax, financial, or other professional advice.

Users should not base important decisions solely on AI-generated content.

In acute crises, health issues, or psychological distress, professional help should be sought.

Astrology features

Mentavo may offer astrology features, such as horoscopes, birth chart calculations, or astrological evaluations.

Astrological content is intended solely for entertainment, inspiration, and self-reflection.

It does not constitute scientifically verified statements, advice, or a prediction of future events.

Users are solely responsible for how they interpret and use astrological content.

User content

Users may create, store, or have processed their own content within Mentavo, for example journal entries, check-ins, goals, habits, notes, chat messages, or other personal information.

Rights to this user content generally remain with the respective user.

However, users grant Mentavo the right to technically store, process, and use this content to the extent necessary to provide the app's features.

Users are responsible for ensuring that their content does not infringe the rights of third parties and does not violate applicable law.

Prohibited use

Mentavo must not be used in an abusive manner.

In particular, the following is prohibited:

• use for unlawful purposes
• uploading or entering unlawful content
• infringing the rights of third parties
• attempting to circumvent technical protection measures
• automated mass use without consent
• extracting, copying, or manipulating the app
• distributing spam, malware, or abusive content
• using the app to harass, threaten, or deceive other people

Mentavo reserves the right to remove content, restrict features, or temporarily or permanently suspend user accounts in the event of violations.

Availability and technical changes

Mentavo strives to provide the app reliably.

However, uninterrupted, error-free, or fully available use at all times cannot be guaranteed.

Maintenance work, security updates, technical disruptions, changes by third-party providers, or force majeure may temporarily limit availability.

Mentavo is entitled to further develop, modify, restrict, or discontinue features to the extent reasonable for users.

Third-party providers

External service providers may be used to provide Mentavo, for example for hosting, database, AI features, error analysis, email delivery, or subscription management.

Further information on the processing of personal data can be found in Mentavo's privacy policy.

For third-party services, in particular the Apple App Store, Google Play Store, or external links, the respective terms of the third-party provider apply in addition.

Privacy

The processing of personal data is carried out in accordance with Mentavo's privacy policy.

The privacy policy is available separately and does not form part of these Terms in the strict sense.

Intellectual property

All rights to Mentavo, in particular to the name, logo, design, user interface, texts, graphics, software, structure, concepts, and other content, remain with Mentavo or the respective rights holders.

Users receive only a simple, non-transferable, and revocable right to personal use of the app under these Terms.

Commercial use, reproduction, modification, distribution, publication, or disclosure of parts of the app is not permitted without Mentavo's prior consent.

Liability

Mentavo is liable without limitation for intent and gross negligence, as well as for injury to life, body, or health.

In cases of slight negligence, Mentavo is liable only for breach of material contractual obligations. In such cases, liability is limited to the foreseeable damage typical for this type of contract.

Mentavo assumes no liability for decisions made by users based on app content, AI-generated responses, astrological evaluations, or personal reflections.

Mentavo does not guarantee that using the app will achieve specific goals, permanently build habits, reduce psychological stress, or bring about personal development.

No substitute for professional help

Mentavo is not medical, psychological, psychotherapeutic, psychiatric, legal, tax, or financial advice.

The app does not provide diagnosis, treatment, or therapy.

In the event of health, psychological, or acute personal problems, users should seek professional help.

In an acute emergency, local emergency services or an appropriate crisis service should be contacted immediately.

Account deletion

Users may delete their account at any time within the app, provided this feature is offered.

Upon account deletion, personal data is erased in accordance with the privacy policy, unless statutory retention obligations require otherwise.

Deleting an account does not automatically cancel a subscription entered into via Apple or Google. Subscriptions must additionally be cancelled through the respective app store.

Termination by Mentavo

Mentavo may suspend or terminate user accounts if users materially breach these Terms, misuse the app, or violate applicable law.

For minor violations, Mentavo will, where reasonable, first set an appropriate deadline for remedy.

Changes to these Terms

Mentavo may amend these Terms where necessary due to legal, technical, or organizational developments.

Users will be informed of material changes in an appropriate manner.

If users do not object to the changes within a reasonable period and continue to use Mentavo, the changes are deemed accepted, provided this was expressly pointed out.

Applicable law

The law of the Federal Republic of Germany applies.

Mandatory consumer protection provisions of the country in which users have their habitual residence remain unaffected.

Dispute resolution

Mentavo is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Final provisions

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by the applicable statutory provisions.
